Terms of Service
The agreement between you and the app — including what the evidential features do and do not promise.
Last updated 29 August 2026 · Applies to Moo's Diary (moos-diary.com)
Draft document — not yet legally reviewed.
This was drafted to describe, accurately and in detail, how the app actually works. It has not been reviewed by a solicitor and is not a substitute for legal advice. It is a starting point for professional review before the app is used by anyone outside the family who tested it.
Acceptance of these terms
By creating or using an account on Moo's Diary, you agree to these Terms of Service, the Privacy Policy, the Data Retention Policy, and the Safeguarding Statement. There is no public sign-up — every account is created by invitation from an existing Family Owner, by a platform administrator, or through an institutional arrangement, and use of the account you were given is subject to these terms regardless of who created it.
Account tiers and what each includes
Family accounts are organised around a Family, owned by a Family Owner, who may invite Contributors. Three subscription tiers apply to a Family, priced monthly:
- Lite (£1.99/month) — the core diary: entries, media, Sleep/Food/Communication tracking, Strategies, Wins, and the insight/reporting features not listed as paid add-ons below.
- Family (£4.99/month) — everything in Lite, plus Ask Moo (one nominated seat per family), WhatsApp reminders, court messaging, AI letter/report generation, EHCP intelligence features, and evidence bundle export.
- Family Plus (£9.99/month) — everything in Family, plus Ask Moo access for every family member independently rather than a single nominated seat, each with their own monthly allowance.
A new family gets a 30-day trial with no card required. If the trial ends with no payment method on file, the subscription is paused to Lite-equivalent access rather than cancelled or deleted — your data and account are not affected. If a payment fails after that, full access continues for a 14-day grace period before the account moves to Lite-equivalent access; it is never simply switched off. Downgrading a subscription, whether by choice or through non-payment, never restricts reading your own existing data — the paid features it gates are all on the write/generate side.
Professional accounts are not subscribed to independently — a professional gains access to a specific child only when a Family Owner grants it, and pays nothing directly for that access unless they separately hold their own Family subscription for their own child. Where a professional's employer (a school, clinic or similar) holds an institutional account, that organisation is billed directly for the children enrolled under it and for a shared, prepaid allowance covering that professional's use of Ask Moo — this is invoiced to the institution, not charged to the professional or the family.
Institutional accounts are agreed and invoiced separately from the consumer tiers above, at a negotiated per-enrolled-child rate, with usage-based AI costs drawn down from a prepaid credit balance topped up against a real payment received. An institutional account confers no access to any child's records on its own — access still comes only from that child's family granting it to a named professional, exactly as for any other professional account.
Acceptable use
You agree not to:
- Use the app to log information about a child you are not authorised to keep records about, or to misrepresent who authored an entry.
- Attempt to access another family's data, or a child's records you have not been granted access to, by any means other than the access the app itself grants you.
- Use a professional or institutional account to look up or compare children without a genuine professional basis for doing so, even where the technical access exists.
- Upload content you do not have the right to upload, or that is unlawful, or that is intended to harass, defame, or endanger any person, including the child the record is about.
- Attempt to circumvent, probe, or interfere with the app's access controls, rate limits, or security measures.
- Use any automated system to scrape or bulk-extract data from the app outside its own export features.
- Use Ask Moo or any other AI feature to generate content you then present as an unedited, unreviewed factual record — AI output is a drafting aid and an analysis tool, not a substitute for your own observation.
We reserve the right to suspend or terminate an account that breaches this section, particularly where a breach risks another family's privacy or a child's safety.
The evidential/court-related features — what they do and don't guarantee
The app includes features designed to make a diary a more credible record for use in family court or similar proceedings: entries lock against silent editing after 24 hours, corrections are made through a visible Amendment that preserves the original rather than overwriting it, digital signing exists for entries and incidents, an audit trail records significant actions, and export features produce PDF bundles intended to be readable by a court or solicitor.
These features do not, and cannot, guarantee that any specific document produced by the app will be accepted as evidence, given any particular weight, or found admissible by any specific court, tribunal, or authority. Admissibility and evidential weight are matters of law and procedure decided by the relevant court, judge, or tribunal in the specific proceedings — not something a software feature can determine in advance.
The app is a record-keeping tool. It does not provide legal advice, does not represent your case, and using it does not create a solicitor-client relationship of any kind. If you are involved in legal proceedings, you should seek independent legal advice about what evidence is appropriate, how to present it, and whether material from this app is suitable for your specific case.
AI-generated content
Insights, summaries, suggested tags, and Ask Moo's answers are generated by AI models and can be wrong, incomplete, or subtly miscalibrated, in the way any AI system can be. They are provided to help you notice patterns and save time, not as a definitive or clinical assessment of a child. Where the app declines to draw a conclusion (for example, refusing to infer that a parent has “under-logged” or that a behaviour has “regressed” from an absence of entries), that caution is deliberate, and you should apply the same caution yourself when reading anything the AI generates. AI-generated content is never treated by the app as an established fact about a child, and you should not treat it that way either — particularly before repeating it to a professional, a court, or another parent.
Your content, and your responsibility for it
You retain ownership of the content you log. You are responsible for the accuracy of what you enter — the app is built on the principle that a wrong structured value is worse than an honest gap, and it is designed to avoid guessing on your behalf, but it cannot verify that what you type is true. By contributing an entry, you confirm it is accurate to the best of your knowledge at the time you wrote it.
You grant us the licence necessary to store, process, back up, and display your content back to you and to whoever you have given access to it, for the sole purpose of operating the service. We do not use your content for any other purpose, including training our own models, and we do not sell it.
Liability
The app is provided on an “as is” and “as available” basis. While we take the reliability of this app seriously — including daily database backups and a weekly media backup — we do not guarantee the service will be uninterrupted, error-free, or available at all times, and we are not liable for data loss arising from causes outside our reasonable control.
To the maximum extent permitted by law, our liability for any claim arising from your use of the app is limited to the amount you paid for the service in the twelve months before the claim arose. We are not liable for indirect or consequential loss, including any adverse outcome in legal proceedings connected to material produced by the app. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited or excluded.
Cancellation and termination
You may cancel a subscription at any time from Settings; cancelling moves the family to Lite-equivalent access rather than deleting anything — see the Data Retention Policy for exactly what happens to your data. An individual can delete their own account from Settings, which disables login immediately and schedules the account for permanent removal after 90 days, subject to the legal-hold exception described there.
We may suspend or terminate an account for breach of the Acceptable Use section above, for non-payment beyond the grace period, or where required by law. Where reasonably possible, we will give notice before doing so.
Changes to the service
This is an actively developed app, and features, pricing, and these terms may change over time. We will make reasonable efforts to communicate material changes, particularly anything affecting billing or who can see what. Continued use of the app after a change to these terms constitutes acceptance of the updated terms.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them, without prejudice to any right you have as a consumer to bring proceedings in your own jurisdiction.
